PRESS RELEASE
 DMK Organisation Secretary R.S.Bharathi, M.P., along with DMK Headquarters Advocate R.Neelakandan met  The Tamil Nadu State Election Commissioner and submitted a Compliant  today (1.12.2020) regarding Sivagangai District Panchayat Chairman Election.

Sir,
1. There is no indirect election conducted for a long period to the post of Chairman of Sivaganga District Panchayat Council, even after the results of the election to the post of District Panchayat Ward Members, as early as in the month of January 2020. Knowing fully well that our DMK party’s candidate would win in the said elections, the same were being postponed for want of quorum. Even after the postponement of the election thrice on the same reason, the election which ought to be conducted as per Tamil Nadu Panchayats Election Rules framed under Tamil Nadu Panchayats Act, it did not take place so far, at the influence of the ruling party, as they do not have majority to win in the election.  
2. Election to the posts of Chairman and Vice-Chairman of District Panchayat Council is necessary, to discharge its functions and duties as per Tamil Nadu Panchayats Act, 1994.
3. In the said circumstances, a Writ Petition was jointly filed by the Ward Members of our DMK party, before the Hon’ble Madras High Court in W.P. No.14988 /2020, in which an undertaking was given by the State Election Commission to conduct the election within a period of two weeks. Recording the said undertaking an order was passed by the Hon’ble High Court on 11.11. 2020 and the relevant portion of the order is as follows:
“2. Mr.Nedunchezhian, learned counsel appearing on behalf of Tamil Nadu State Election Commission submitted that the Election Commission will notify the elections within a period of two weeks from today. The learned counsel submitted that this undertaking given by the first respondent Election Commission can be recorded.
3. The undertaking given by the first respondent is hereby recorded and it is made clear that the Election Commission will notify the date of election within a period of two weeks from today and thereafter, proceed to conduct the election.
4. This Writ Petition is disposed of accordingly…”
4. In compliance of the undertaking, recorded in the order of Hon’ble High Court, a notification was issued on 24.11.2020 by the Tamil Nadu State Election Commission to conduct the said election on 04.12.2020. Following the said notification, a notice of election was issued to our Party’s Ward Members by the Returning Officer/ District Collector, Sivaganga District for the election to the post of Chairman at 10.00 am on 04.12.2020 at the office of the District Collector and the election to the post of Vice-Chairman at 03.00 pm on the same day in the same venue. 
5. After the above said schedule of election, as notified by the State Election Commission, it is now announced by the State Government that Hon’ble Chief Minister will hold a Review Meeting at Sivaganga District Collectorate on the same day i.e. 04.12.2020.
6. When the election is pre-scheduled on 04.12.2020, the Review Meeting is purposely planned and announced at the instance of the ruling AIADMK party to commit all possible electoral malpractices. Under the guise of attending the meeting, to be chaired by the Hon’ble Chief Minister, AIADMK party’s functionaries would assemble in the District Collector’s premises, where the election is scheduled and they would adopt all illegal methods to prevent free and fair election. In fact, in earlier occasions, despite the police protection, illegal attempts have been made by the ruling party people, with muscle power to prevent our party’s Ward Members from participating in the election. Abduction of Electors/Ward members has also taken place. Similar pre-planned incident would certainly happen, if the review meeting is allowed on the same day, in the same venue. The present election is notified prior to the announcement of Review Meeting. Hence, the Review Meeting only, shall be postponed to some other day, after the election is over. 
7. In this regard, all the Ward Members belonging to our DMK Party made a representation requesting to change the date of Review Meeting by the Chief Minister; to conduct free and fair election without any illegalities at the hands of ruling AIADMK party and to provide adequate police protection to our party’s Ward Members.  
Therefore, our party hereby requests you to forthwith issue appropriate orders directing the Government of Tamil Nadu to re-schedule the Review Meeting of the Hon’ble Chief Minister, scheduled on 04.12.2020 at Sivaganga and to hold the same, after pre-scheduled election to the posts of Chairman and Vice-Chairman of Sivaganga District Panchayat Council is over; and conduct the said election as per schedule in free and fair manner, by providing adequate police protection, enabling all the Ward Members of our DMK party to participate in the said election process, in the presence of an observer in the rank of a District Collector.
